These Terms of Use (ToU) govern access to and use of the buzzers.fit website, its subdomains, the BuzzersFit mobile app and the associated services (hereinafter "the Platform"), published by Joris Gounand, sole proprietor (SIREN 903 135 671). BuzzersFit is a technical platform: it provides competition organisers and gyms with management, timing, registration and booking tools. Competitions and sports services remain organised and sold by the organisers and gyms, who are solely responsible for how they are run, their safety and their legal obligations. The terms applicable to purchases made through the Platform are set out in the Terms of Sale.
Acceptance of the Terms of Use and the Privacy Policy is collected when the account is created (checkbox). The accepted version, its date, the IP address and the browser used are recorded as proof. Each version of the Terms of Use is dated. Browsing the public pages of the Platform (competitions, leaderboards) without an account constitutes acceptance of these Terms of Use for that use.
Creating an account is reserved for persons aged 15 or over. Participation of a minor aged 15 to 17 in a competition requires the authorisation of their legal representative, collected under the responsibility of the competition organiser. Users undertake to provide accurate information when registering and to keep it up to date, to keep their credentials confidential and not to share their account. Any activity carried out from an account is deemed to have been carried out by its holder, unless proven otherwise. If you suspect unauthorised access, change your password and contact team@buzzers.fit.
A gym may create an account in the name of one of its members in order to manage their memberships and bookings. The member is informed of this and accepts these Terms of Use upon first accessing the account. They may request the deletion of this account at any time by writing to team@buzzers.fit (see the Privacy Policy).
The Platform offers in particular: • Timing of CrossFit competitions with connected buzzers and real-time leaderboards • Management of registrations, teams and competition schedules • Online qualifiers (video submission and review) • Athlete space: schedule, results, workout log, badges • Gym management: memberships, class bookings, shop • Live-streaming overlays and judge tools • Event access control via QR code • Usage help assistant (AI) The available features depend on the services activated by each organiser or gym.
You retain ownership of the content you publish on the Platform (photos, videos, bios, comments, workout results). By publishing it, you grant BuzzersFit a non-exclusive, worldwide, free licence, limited to hosting, displaying and distributing this content on the Platform for the needs of the services (for example displaying a qualifier video to the competition judges). This licence ends when you delete the content or your account, subject to temporary technical copies and legal retention obligations. You warrant that you hold the necessary rights to the published content, including the image rights of the people visible in it. Unlawful, infringing, defamatory, hateful, violent or sexual content, or content infringing the privacy of others, is prohibited. Any unlawful content can be reported to team@buzzers.fit, stating its location (link) and the reason for the report. BuzzersFit reviews reports and promptly removes any manifestly unlawful content, in accordance with the French LCEN law and Regulation (EU) 2022/2065 (DSA). The address team@buzzers.fit is BuzzersFit's single point of contact within the meaning of articles 11 and 12 of Regulation (EU) 2022/2065 (DSA), both for authorities and for recipients of the service.
Users undertake to: • Use the Platform in accordance with its purpose and applicable regulations • Not disrupt or attempt to circumvent the operation or security of the service • Not access or attempt to access third-party accounts or data • Not collect other users' personal data • Respect intellectual property rights • Not use the Platform for unsolicited canvassing
In the event of a breach of these Terms of Use (unlawful content, fraud, disruption of the service, manifest score manipulation), BuzzersFit may remove content, or restrict, suspend or delete an account. The user is informed and may, except in cases of urgency or a contrary legal obligation, submit their observations by writing to team@buzzers.fit. Organisers and gyms also have their own sporting and disciplinary rules, which they apply under their own responsibility.
The Platform (software, code, design, logos, databases, texts) is the exclusive property of BuzzersFit or its licensors. Any unauthorised reproduction, extraction or reuse constitutes infringement. Trademarks and content of competitions and gyms remain the property of their respective owners. Content published by users remains theirs (see the User content section).
BuzzersFit strives to provide continuous access to the Platform but does not guarantee any level of availability (no SLA): interruptions for maintenance, updates or force majeure are possible, and features may change. BuzzersFit is not responsible for interruptions attributable to networks, hosting providers or third-party services.
BuzzersFit is bound by an obligation of means in providing the Platform. It is not responsible for the running of competitions and sports services, which are the responsibility of the organisers and gyms, nor for damage resulting from use of the Platform that does not comply with its purpose. Nothing in these Terms of Use limits the mandatory rights granted to consumers or BuzzersFit's liability in the event of wilful misconduct, gross negligence or personal injury.
BuzzersFit may amend these Terms of Use, in particular to reflect changes to the service or to regulations. Any substantial change will be notified to you (by email and/or a banner on the Platform) at least 15 days before it takes effect. If you refuse the new terms, you may stop using the Platform and close your account free of charge. The version applicable to a dispute is the one in force at the time of the facts, each version being dated and archived.
These Terms of Use are governed by French law. In the event of a dispute, an amicable solution is sought as a priority (team@buzzers.fit). Consumers may use, free of charge, the consumer mediator designated in the Terms of Sale. Failing that, the French courts have jurisdiction, subject to the mandatory jurisdiction rules applicable to consumers. The Terms of Use are written in French; in the event of a discrepancy with a translation, the French version prevails.
