These Terms and Conditions of Sale apply to all sales of services and digital products made on the website www.buzzers.fit, published by Joris Gounand, sole proprietor (SIRET: 903 135 671 00019), hereinafter referred to as "BuzzersFit". Any order implies unreserved acceptance of these Terms of Sale.

BuzzersFit offers the following services: • CrossFit competition registration (B2C) — one-time payment • Gym credit packs (B2C) — one-time payment • SaaS subscriptions for gym managers (B2B) — monthly subscription • Event plans for competition organizers (B2B) — one-time payment • Premium mobile subscription (B2C) — monthly subscription via App Store/Google Play
Competition registrations are managed by organizers through the Stripe Connect platform. The competition organizer is the primary seller (merchant of record). BuzzersFit acts as a technical intermediary. • Prices are set by the organizer and displayed inclusive of all taxes • Payment is made by credit card via Stripe • A registration confirmation is sent by email • Cancellation and refund conditions are defined by each organizer • BuzzersFit charges a service fee on each transaction
Credit packs allow booking classes and services at partner gyms. • Credits are available for use immediately after purchase • Credits are personal and non-transferable • Credits do not expire unless otherwise specified by the gym • Payment is made by credit card via Stripe
SaaS subscriptions are intended for professional gym managers. • Subscriptions are monthly with automatic renewal • Prices are set according to the chosen plan and may be revised with 30 days' notice • Payment is automatically charged each month via Stripe • Cancellation is possible at any time, effective at the end of the current billing period • In case of late payment, late penalties at 3 times the legal interest rate apply, as well as a fixed recovery indemnity of EUR 40 (art. D441-5 of the French Commercial Code)
Event plans are intended for professional competition organizers. • The plan is linked to a specific event • Prices are set according to the chosen plan • Payment is made before the event • The plan includes access to timing tools, leaderboard and management features for the duration of the event
The premium subscription is managed by Apple (App Store) or Google (Google Play). • Purchase, renewal and cancellation conditions are governed by Apple's or Google's terms and conditions • BuzzersFit is not involved in the payment or refund process • To cancel, go to your App Store or Google Play settings
Payments are securely processed by Stripe (https://stripe.com). BuzzersFit does not store any credit card data on its servers. Accepted payment methods: credit card (Visa, Mastercard), SEPA (subject to availability). Prices are displayed in euros (EUR) inclusive of all taxes. The sole proprietor is exempt from VAT (article 293 B of the French General Tax Code).
In accordance with Articles L221-18 and L221-28 of the French Consumer Code: • Competition registrations: the right of withdrawal does not apply to leisure services to be provided on a specific date (art. L221-28, 12) • Credit packs: the right of withdrawal does not apply to digital content whose performance has begun with the express consent of the consumer and their express waiver of the right of withdrawal (art. L221-28, 13) • B2B subscriptions: the French Consumer Code does not apply to business-to-business relationships • Premium mobile subscription: governed by Apple/Google terms By accepting these Terms of Sale and proceeding with payment, the consumer acknowledges having been informed of these exclusions.
• Competition registrations: refunds are handled by the organizer according to their own terms. In case of dispute, contact the organizer first, then BuzzersFit • Credit packs: no refund after credits have been used. Unused credits may be refunded upon justified request • B2B subscriptions: no pro-rata refund in case of cancellation during the current period • All refunds are made using the same payment method used for the original purchase
• Monthly subscriptions (B2B): cancellation is possible at any time from your management dashboard, effective at the end of the current period. In accordance with the French law of August 16, 2022, cancellation can be performed online in 3 clicks or less • Premium mobile subscription: cancellation via your App Store or Google Play settings • User account: deletion available upon request at joris@gounand.fr
In accordance with Articles L611-1 and L612-1 of the French Consumer Code, in the event of an unresolved dispute, the consumer may use a consumer mediator free of charge. Mediator: CNPM — Chambre Nationale des Praticiens de la Mediation Website: https://cnpm-mediation-consommation.eu Address: 27 avenue de la Liberation, 42400 Saint-Chamond, France Before contacting the mediator, the consumer must have attempted to resolve the dispute directly with BuzzersFit by email at joris@gounand.fr. Note: Enrollment with the mediation service is being finalized. In the meantime, any dispute can be addressed directly by email to joris@gounand.fr.
BuzzersFit undertakes to provide its services with due diligence. However: • BuzzersFit cannot guarantee permanent service availability (best-efforts obligation) • BuzzersFit is not responsible for events organized by third parties through the platform • For competition registrations, the organizer is solely responsible for the proper conduct of the event • BuzzersFit's liability is limited to the amount paid by the client for the relevant service

These Terms of Sale are subject to French law. For consumers residing in the European Union, the mandatory provisions of the law of their country of residence apply. In the event of a dispute, French courts have jurisdiction, subject to the applicable rules of jurisdiction for consumers.
