Terms of Sale

Preamble

These Terms of Sale govern sales made through the BuzzersFit platform (buzzers.fit website, subdomains and mobile app). They apply in addition to the Terms of Use. Acceptance of the Terms of Sale is collected when paying for a competition registration (checkbox); the accepted version, its date, the IP address and the browser used are recorded as proof. For other purchases, confirming the order constitutes acceptance of the Terms of Sale in force, which are accessible at any time on this page.

Platform operator

Who sells what

BuzzersFit is a technical marketplace. The seller of each offer is identified before payment: • Competition registrations, workshops and event-related options (for example a heat change): the seller is THE ORGANISER of the competition, identified on the event page. The organiser sets the prices, defines their cancellation and refund policy, and is responsible for delivering the service and for their tax obligations (including VAT where applicable). • Memberships, session packs, drop-in classes and gym shops: the seller is THE GYM concerned, under the same conditions. • BuzzersFit sells in its own name only: the service fees (see the dedicated section), the BuzzersFit wallet credit packs and its services for professionals (platform licences, per-event packages, add-ons, AI credits, sponsor placements). Payments are collected via Stripe and transferred directly to the seller concerned (Stripe Connect), less the fees due to the platform.

Competition registrations

Registration prices are set by the organiser and displayed inclusive of all taxes before payment, in the competition's currency. A confirmation is sent by email after payment. The cancellation and refund policy for a registration is the organiser's: check the event page or contact them before registering. If the competition is cancelled by the organiser — an exceptional situation — refunds are the organiser's responsibility; BuzzersFit assists with their processing through its support (team@buzzers.fit). Some competitions offer early-bird prices (reserved for the first paid registrations) and promo codes: the discount applies to the ticket price and is borne by the organiser.

BuzzersFit service fee

For paid registrations, BuzzersFit charges the athlete, in its own name, a service fee added to the price set by the organiser. This fee is displayed and itemised before the payment is confirmed. It consists of: • a platform share, which pays for BuzzersFit's services; • a banking-cost cover, calculated on the total amount collected. The service fee is calculated on the ticket price before any discount: a promo code reduces the ticket price, not the service fee. No service fee is charged for free registrations or for payments made with credits. If the registration is refunded in full, the service fee is refunded in full. If it is partially refunded, the fee is refunded proportionally.

Services sold by gyms

Gyms sell through the platform their memberships (recurring subscriptions), session packs, drop-in classes and shop items. The prices and terms specific to each offer — including any cancellation notice period (see the Cancellation section) — are displayed before subscribing. The gym is solely responsible for delivering these services. Class bookings: cancelling a booking within the time limit set by the gym automatically returns the amount according to the payment method used (session credited back to the pack, credits returned to the wallet, or card payment refunded). After this time limit, the session is due. Shop purchases paid with credits are debited from the wallet; if a cancellation is accepted by the gym, they are credited back.

BuzzersFit credit packs

BuzzersFit sells credit packs that top up a wallet usable at partner gyms (bookings, shop). The content of each pack (credits received, any bonus) and its price are displayed before payment. Credits are personal, non-transferable and usable immediately after purchase; they have no expiry date of their own. The right of withdrawal applicable to credit packs is described in the Right of withdrawal section.

Services for professionals (B2B)

BuzzersFit sells to organisers and gyms: platform licences (monthly subscription with tacit renewal), per-event packages, the gym premium add-on (monthly subscription), AI credits and sponsor placements on competition pages. • Prices are displayed before ordering; subscriptions are charged automatically via Stripe. • Cancellation of professional subscriptions is described in the Cancellation section. • Sponsor placements: the placement is subject to approval by the competition organiser; if it is rejected, the payment is automatically refunded in full. • Late payment between professionals: penalties at 3 times the statutory interest rate and a fixed recovery indemnity of €40 (art. L441-10 and D441-5 of the French Commercial Code). • Consumer law (withdrawal, mediation) does not apply to business-to-business relationships.

Mobile premium subscription

The mobile app premium subscription is purchased from Apple (App Store) or Google (Google Play). Payment, renewal, cancellation and refunds are governed by Apple's or Google's terms and managed from your store settings. BuzzersFit is not involved in these payments.

Prices and payment

Payments are processed securely by Stripe; BuzzersFit does not store any card data. Payment methods: bank card and, depending on the offer and currency, other methods offered by Stripe (for example SEPA direct debit for euros). Some purchases can be paid with BuzzersFit wallet credits. Memberships paid by SEPA direct debit managed by the gym are covered by a direct debit mandate signed online. Prices are displayed inclusive of all taxes, in the currency shown on the offer page (euro by default; some competitions use another currency). The total amount, including the service fee where applicable, is displayed before the payment is confirmed, and confirming it entails an obligation to pay. VAT: sales by organisers and gyms fall under their own tax regime — where VAT applies, it is calculated and displayed at the time of payment. Sales made by BuzzersFit in its own name are issued under the French VAT franchise (art. 293 B CGI).

Right of withdrawal

In accordance with articles L221-18 et seq. of the French Consumer Code: • Competition registrations, workshops and class bookings for a specific date: the right of withdrawal does not apply to leisure activities to be provided on a specific date or period (art. L221-28, 12°). • Subscriptions, session packs, add-ons, credit packs and other services concluded at a distance: you have a withdrawal period of 14 days from subscription (art. L221-18). Send your request to team@buzzers.fit, for example using the form appended to these Terms of Sale. The refund is made using the same payment method, no later than 14 days after your request. • Credit packs: the right of withdrawal applies; if you have started using your credits during the period, the refund is made pro rata to the unused credits. • If you expressly request that a service starts before the end of the withdrawal period and then withdraw, the service already provided remains due pro rata (art. L221-25). • The right of withdrawal does not apply to business-to-business relationships. • Mobile premium subscription: Apple's or Google's terms apply.

Refunds and cancellations

• Competition and workshop registrations: the cancellation and refund policy is the organiser's (see the event page or contact them). An athlete cancelling their participation in a workshop does not trigger an automatic refund. • Cancellation of an event by the organiser: refunds are the organiser's responsibility; in the event of a full refund, the BuzzersFit service fee is also refunded. Support (team@buzzers.fit) assists with the processing. • Class bookings: a cancellation within the time limit set by the gym automatically returns the amount (pack session, credits or card refund, depending on the payment method used). • Purchases paid with credits: refunds granted by the gym are credited back to the wallet. • Sponsor placements rejected by the organiser: automatic full refund. • Any refund due under the right of withdrawal is made using the same payment method as the purchase.

Cancellation

• Gym memberships (members): cancellation can be done at any time from your member space, online and in a few clicks (French law of 16 August 2022). The gym may set a notice period of 0 to 3 months, displayed on the plan before subscribing; the cancellation takes effect at the end of the notice period or, if there is none, at the end of the current period. • Professional subscriptions (platform licences, gym premium add-on): cancellation at any time from the management space, with immediate effect; periods already invoiced are not refunded pro rata. • Mobile premium subscription: cancellation via your App Store or Google Play settings. • User account: closure on request to team@buzzers.fit.

Legal guarantee of conformity

Digital services provided to consumers by BuzzersFit benefit from the legal guarantee of conformity provided for in articles L224-25-12 et seq. of the French Consumer Code: BuzzersFit is liable for conformity defects of the service throughout its provision. The consumer may obtain the service being brought into conformity or, failing that, a price reduction or termination of the contract, free of charge.

Consumer mediation

In accordance with articles L612-1 et seq. of the French Consumer Code, any consumer may use, free of charge, a consumer mediator with a view to the amicable resolution of a dispute with BuzzersFit. Mediator: CNPM — MÉDIATION DE LA CONSOMMATION Address: 27 avenue de la Libération, 42400 Saint-Chamond, France Website: https://cnpm-mediation-consommation.eu Before referring the matter to the mediator, first send your written complaint to BuzzersFit (team@buzzers.fit). The mediator may be contacted if the dispute has not been resolved within two months of your complaint. For disputes relating to a registration, membership or purchase sold by an organiser or a gym, the seller is that organiser or gym: address your complaint to them first; BuzzersFit can pass on your request.

Liability

BuzzersFit provides its services with diligence (obligation of means) but does not guarantee uninterrupted availability of the platform. Organisers and gyms are solely responsible for the services they sell (running of events, classes, participant safety). With regard to professional customers, BuzzersFit's liability is limited to the amount paid for the service concerned over the last 12 months. This cap does not apply to consumers: nothing in these Terms of Sale limits consumers' mandatory rights or BuzzersFit's liability in the event of wilful misconduct, gross negligence or personal injury.

Applicable law

These Terms of Sale are governed by French law. For consumers residing in the European Union, the mandatory provisions of the law of their country of residence remain applicable. In the event of a dispute, and failing an amicable resolution or mediation, the French courts have jurisdiction, subject to the mandatory jurisdiction rules applicable to consumers. The Terms of Sale are written in French; in the event of a discrepancy with a translation, the French version prevails.
